Refund Policy

This Refund Policy outlines your rights and our procedures for returns, refunds, and exchanges when you purchase from Daniel Small.

Your Consumer Rights

Under Australian Consumer Law, you are entitled to a remedy when goods or services you purchase:

  • Arrive damaged or defective
  • Do not match the description
  • Are not of acceptable quality
  • Are not fit for the stated purpose

For major failures: You can choose between a refund or replacement. The choice is yours, not ours.

For minor failures: We will offer free repair (or refund/replacement if repair is unreasonable or takes too long).

Refund amount: Full purchase price including original shipping costs.

Consumer Guarantees

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Major Failures

A major failure occurs when:

  • The goods are significantly different from the description, sample, or demonstration model
  • The goods are substantially unfit for their common purpose and cannot easily be fixed within a reasonable time
  • The goods are unsafe
  • The goods have a problem that would have stopped you from buying them if you had known about it

For major failures: You can choose between a refund or replacement. The choice is yours, not ours.

Minor Failures

For minor failures: We will offer free repair within a reasonable time. If repair is not possible or would take too long, we will provide a replacement or refund.

Damage in Transit

Report within 24-48 hours of delivery.

If your order arrives damaged, please follow these steps:

  1. Contact us immediately at Support at Daniel Small <support@daniel.kulchu.red>
  2. Provide photographic evidence of the damage, including:
    • Photos of the damaged item(s)
    • Photos of the packaging and shipping box
    • The shipping label if visible
  3. Note damage on delivery receipt if possible when signing for the package
  4. Retain the item and all packaging materials until we advise otherwise

Our Response

Upon receiving your damage report with evidence, we will arrange one of the following:

  • Full refund to your original payment method, OR
  • Replacement item (if available), OR
  • Free professional repair (if appropriate for the item)

Return shipping costs for damaged goods are our responsibility. We will provide a prepaid shipping label or arrange collection.

Insurance Claims

High-value shipments are automatically insured. Your timely damage report and photographic evidence help us process insurance claims efficiently to ensure you receive your remedy without delay.

Change of Mind Returns

We do not accept returns for change of mind. All sales are final unless the item is damaged, defective, or does not match the description.

Print-on-Demand Orders

Prints are made to order and produced by our third-party fulfillment partner after you place the order. Each print is bespoke to the specifications you select at checkout (size, paper, source image) and is not held in stock.

Production & Cancellation Window

Print-on-demand orders are committed to our fulfillment partner immediately after payment is confirmed and enter production within minutes.

Cancellation requests received before our fulfillment partner has begun production will be honoured in full. Once production has begun, cancellation is not available and the order is non-refundable, except where required by law or where the product fails to meet the consumer guarantees set out above.

To request a cancellation, email Support at Daniel Small <support@daniel.kulchu.red> immediately after ordering. We will attempt cancellation with our fulfillment partner on receipt; success is not guaranteed and depends on production status at the moment we relay the request.

Damaged or Defective Prints

Report within 7 days of delivery to Support at Daniel Small <support@daniel.kulchu.red>. Include your order number, a description of the issue, and photographs of the print and packaging. Late reports may prevent us from obtaining a remedy from our fulfillment partner; statutory rights are not limited by this window.

Where a fault is confirmed, we will arrange a free reprint or full refund at no cost to you. Return postage (if requested) will be reimbursed.

Shipping Address Accuracy

You are responsible for providing an accurate shipping address at checkout. Parcels returned to sender due to an incorrect or incomplete address cannot be recovered; in such cases a reorder at your cost may be required.

Change of Mind & Post-Production Refunds

Because each print is custom-made to your specifications, change-of-mind refunds are not available once production has begun. This restriction does not affect your statutory rights under the consumer guarantees set out above.

Non-Defective Returns

Because each print is custom-made, we are unable to accept returns for change of mind, colour preference, or unwanted items, except where the consumer guarantees above apply.

How to Request a Refund

To request a refund under your consumer rights:

  1. Contact us at Support at Daniel Small <support@daniel.kulchu.red> within a reasonable time of discovering the issue
  2. Provide your order number and details of the problem
  3. Include photos or evidence of the issue if applicable
  4. We will respond within 7 business days with next steps

Refund Processing

Once your refund is approved:

  • Refunds are processed to the original payment method
  • Credit card refunds typically appear within 5-10 business days
  • You will receive an email confirmation when the refund is processed

Shipping Insurance

All shipments over A$100 are automatically insured. Insurance covers loss or damage during transit.

Insurance claims must be filed within 120 days of shipment. Your timely damage report and photographic evidence help us process claims efficiently.

This shipping insurance applies to original artworks. Print-on-demand prints are covered separately under the reprint and refund process described above.

Exchanges

Due to the unique nature of our products, exchanges are handled on a case-by-case basis. If you received a damaged or defective item and prefer a replacement over a refund, please let us know and we will do our best to accommodate your request subject to availability.

Governing Law

These terms and conditions are governed by and construed in accordance with the laws of AU. You irrevocably submit to the exclusive jurisdiction of the courts in that location.

Dispute Resolution

If a dispute arises, we encourage you to contact us first to seek a resolution. We will make reasonable efforts to resolve any disputes through good faith negotiation.

If we cannot resolve a dispute through negotiation, the dispute may be referred to mediation or other alternative dispute resolution mechanisms before court proceedings are commenced.

Severability

If any provision of these terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
